Chengdu Mahamati Technology Co., Ltd. ("we", "us" or "our") develops and publishes SoundSnap, a voice- and headphone-controlled camera app for taking photos and recording video. All content is stored on your device.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING SOUNDSNAP.

By downloading, installing, or using the App, you accept these Terms of Service. If you do not accept them, please do not use the App.

1. Use of the App

1.1 Privacy

By using the App, you consent to our processing of data as set forth in our Privacy Policy. Our Privacy Policy is designed to be compliant with applicable data protection laws, including where relevant the GDPR.

1.2 Lawful use

You agree to use the App only for purposes permitted by these Terms and applicable law. You agree to comply with all local laws regarding the download, installation, and use of the App.

1.3 No liability for third-party content

We are not responsible or liable for any content accessed through the App or via third-party websites or services. You are solely responsible for your use of the App.

1.4 Updates and availability

The App may communicate with our servers or third-party services from time to time (e.g. for updates). We may stop providing the App or certain features at our discretion, without prior notice.

1.5 Prohibited use

You may not use the App to distribute spam, phishing content, or any content that is illegal, harmful, or infringes third-party rights.

2. Camera and media

2.1 Your responsibility

You are solely responsible for ensuring that your use of the App (including any photos or videos you capture) complies with applicable laws. You must not use the App to create or support fraudulent, misleading, or illegal content.

2.2 Local storage

SoundSnap stores your photos and videos only on your device and in your photo library (SoundSnap album). We do not upload or process your content on our servers. If a future version offers optional cloud or third-party features, your use of those features will be subject to these Terms and our Privacy Policy.

2.3 No impersonation or infringement

You may not use the App to generate content that impersonates another person, is defamatory, or violates the privacy or publicity rights of others.

3. Intellectual property

The App and all content in or accessible through it (including interface, text, graphics, images, and software) are owned by Chengdu Mahamati Technology Co., Ltd., its licensors, or suppliers and are protected by copyright and other intellectual property laws. We grant you a personal, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial use. You may not reverse engineer, decompile, disassemble, modify, copy, sell, or commercially exploit the App or any part of it without our express written consent.

4. No warranties and limitation of liability

The App is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App. Our total liability shall not exceed the amount you paid for the App (if any) in the twelve months before the claim, or, if the App was free, fifty United States dollars (USD 50) or the equivalent in local currency.

5. Governing law and disputes

These Terms and any dispute arising from your use of the App shall be governed by the laws of the People's Republic of China, without regard to conflict of law rules. If you are a consumer, this choice of law applies only to the extent it does not deprive you of mandatory protections in your country of residence. Disputes shall be resolved by the courts of the People's Republic of China having jurisdiction, unless mandatory law gives you the right to bring proceedings elsewhere. Any claim must be brought within one (1) year after the events giving rise to it.

6. Changes

We may update these Terms of Service from time to time by posting the new version at this URL. Where required by law or app store policies, we will provide additional notice. Your continued use of the App after the effective date constitutes acceptance. Please review the Terms periodically.

您同意仅在本条款及适用法律允许的范围内使用本应用，并遵守有关下载、安装与使用的当地法律。

1.3 第三方内容

我们对通过本应用或第三方网站、服务获取的任何内容不承担责任。您对自身使用行为负责。

1.4 更新与可用性

本应用可能不时与我们的服务器或第三方服务通信（例如更新）。我们可自行决定停止提供本应用或部分功能，且无需事先通知。

1.5 禁止行为

您不得利用本应用传播垃圾信息、钓鱼内容或任何非法、有害或侵犯第三方权利的内容。

2. 拍摄与媒体

2.1 您的责任

您须确保对本应用的使用（包括所拍摄的照片与视频）符合适用法律。不得利用本应用制作或支持欺诈、误导或非法内容。

2.2 本地存储

SoundSnap 仅将照片与视频保存在您的设备及相册（SoundSnap 相册）中。我们不会在服务器上上传或处理您的内容。若将来版本提供可选的云或第三方功能，您对该等功能的使用须受本条款及隐私政策约束。

2.3 禁止冒充与侵权

您不得利用本应用制作冒充他人、诽谤或侵犯他人隐私或公开权的内容。

3. 知识产权

本应用及其界面、文字、图形、图像、软件等均归成都玛哈玛蒂科技有限公司、其许可方或供应商所有，受著作权及其他知识产权法保护。我们授予您个人、可撤销、非排他、不可转让的许可，供您个人非商业使用。未经我们书面同意，您不得对本应用进行反向工程、反编译、反汇编、修改、复制、出售或商业利用。

4. 免责与责任限制

本应用按「现状」及「可用性」提供。我们不保证其不中断或无错误。在法律允许的最大范围内，我们不对因使用或无法使用本应用而产生的间接、附带、特殊、后果性或惩罚性损害承担责任。我们的总责任不超过您在索赔前十二个月内为本应用支付的金额（如有），或若本应用免费，则不超过五十美元（50 USD）或等值当地货币。

5. 适用法律与争议

本条款及因使用本应用产生的任何争议均适用中华人民共和国法律（不含法律冲突规则）。若您为消费者，该法律选择仅在未剥夺您居住地强制性保护范围内适用。争议应由中华人民共和国有管辖权的法院解决，除非强制性法律赋予您在其他地方提起诉讼的权利。任何索赔须在相关事件发生后一（1）年内提出。

6. 变更

我们可能不时在本页面发布新版本条款。法律或应用商店政策要求时，我们会另行通知。变更生效后继续使用即视为接受。请定期查阅。
